Open Space Acquisition - Morris County
PROBLEM:
Morris County Park Commission used eminent domain to acquire a 27 acre parcel of vacant land in Pequannock for expansion of a county golf course, offering the owner $300,000 for the property on the basis that freshwater wetlands and steep slopes made the property undevelopable.

SOLUTION:
After McKirdy & Riskin was engaged, appraisal and engineering consultants were able to establish that the property could have been developed with single family dwellings notwithstanding the development constraints suggested by the condemning authority.

RESULT:
The County Park Commission agreed to a settlement before trial awarding the owner $1,250,000 as just compensation. The client received an additional $950,000 – more than four times it was originally offered – without having to proceed to trial.
